Usage Policy

User Agreement

  • Please carefully read these Terms ("Terms," "User Agreement") before using our Service. Also, familiarize yourself with our Privacy Policy to understand how we use the personal information you provide.
  • The term "Service" refers to the service provided through the web service "TapWeb.link," with corresponding functionality (the ability to create an "online business card"), with direct buttons for communication through messengers, the ability to create short links, QR codes, but not limited to).
  • Your access to the Site/Services and their use depends on your agreement and compliance with these Terms. These Terms apply to all visitors, users who access the site and/or services.
  • By accessing the Site/Services or using them, you agree to comply with these Terms. If you do not agree with any part of the terms, you must stop using the Site/Service.
  • We reserve the right at our discretion to change or replace any of these Terms of Use or to change, suspend, or terminate access to the site/services (including, among other things, the availability of any feature, database, or content) at any time by sending a notice through the Site/Service, email, or other appropriate electronic communication method, with or without it. We may also impose restrictions on certain features and services or limit users' access to parts or all of the site or services without prior notice and without liability. You agree that we will not be liable to you or any third party for any termination of your access to the Site/Services.
  • Although we timely notify of changes, you should also periodically check these Terms of Use for possible changes. Your continued use of the Site/Services after notice of any changes to the Terms of Use signifies acceptance of these changes, which will apply to your continued use of the site/service in the future. Your use of the Site/Services is subject to the Terms of Use in effect at the time of such use. This version of the Terms of Use is dated November 1, 2023.


Service Payment

Using the Site/Service is conditionally free. There is additional functionality for which payment may be charged. The cost of such functionality is displayed on the main page of the site in the "Choose a plan" section or in the "Prices" section.

Payment Plan Options

Recurring payment (automatic payment every month/year) through the Stripe, WayforPay system (by Card), or other options connected to the site in the "Other payment options" section. You subscribe to monthly or annual payment of the tariff you have chosen. A one-time or recurring payment for the required tariff can be made through: PayPal or Crypto.com, Coinbase (cryptocurrency), or other payment systems that will be added to the site in the future.


Return of funds & Refund Policy

Funds for the paid subscription are not refunded if the subscription has already started in the current month or year. If you wish to opt-out of automatic deductions and unlink your card from such payments, you need to contact us in the future through the website form, chat, or social media channels listed on this site. Provide the account email for which you want to disable such payments. An exception may be if you paid funds to the account through 100% prepayment for several months; in this case, unused months will be refunded minus the transfer fee. If you do not plan to use the service in the future, plan the month from which you intend to discontinue the use of paid subscription plans. Payments for the "Forever," "Lifetime of the service," or "Unlimited," regardless of the site's naming, implying a one-time payment for the entire operational period, are non-refundable.


Usage Eligibility

You confirm and guarantee that you have reached the age at which you have the right to use the Site/Service in your country of residence/citizenship, but at least you must be 16 years old. If you have not reached this age, please do not use the Site/service. Additionally, you do not have the right to access or use the Site/Service if your access or use of the Site/Service is prohibited or violates any local, state, national, or international laws and regulations. You must promptly notify us of any changes to your right to use the Site/Service.


Notifications and Limitations

The Site/Service may contain content provided by us or our partners. Such content is protected by copyright, trademarks, service marks, patents, trade secrets, or other rights and laws. Except as expressly permitted by us, you agree not to modify, copy, frame, clean, lease, sell, distribute, or create derivative works based on such content, in whole or in part. You must comply with all copyright notices, information, and restrictions contained in any content accessible through the Site/Service.


Rules of conduct

By using the Site/Service, you agree not to use it for any purposes prohibited by these Terms of Service.


You must not:

  • Perform any actions that impose or may impose (as determined by us in our sole discretion) unreasonable or disproportionately large load on our infrastructure (or the infrastructure of our third-party providers);
  • Interfere or attempt to interfere with the proper functioning of the Site/Service or any actions conducted on the Site/Service;
  • Circumvent or attempt to circumvent any measures that we may use to prevent or restrict access to the site/services (or other accounts, computer systems, or networks connected to the site/service);
  • Launch any form of autoresponder or "spam" on the Site/Service;
  • Use manual or automated software, devices, or other processes to "scrape" or "spider" any page of the Site/Service;
  • Collect or harvest any content or personal data from the Site/Service;
  • Take any actions that violate our guidelines and policies, use viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit, or interfere with the operation of any software, equipment, or telecommunication equipment or to damage or gain unauthorized access to any system, data, passwords, or other information of ours or any third party.
  • Redirect traffic from the site to pages containing (and posting) adult material, links to dating sites, materials that deceive users, materials with prohibited goods or services in Ukraine, information and links to casinos. Using spam, viruses, trojans for distribution. Links leading to harmful resources will be harshly banned. Users who post links to these resources will be banned.
  • Redirect traffic to sites blocked in social networks.
  • Lead to blocking in social networks pages created on the service.


You must not (directly or indirectly):

  • Decrypt, decompile, disassemble, reconstruct, or otherwise attempt to obtain any source code underlying the idea or algorithms of any part of the Site/Services (including, without limitation, any application), except where applicable laws expressly prohibit such restriction.
  • Conceal and modify copyrights, logos, and mention of the TapWeb.link service unless this feature is included in the paid tariff plan.
  • Modify, translate, or otherwise create derivative works of any part of the Service.
  • Use any intellectual systems, robots, scramblers, or conduct any similar data collection.
  • Copy, lease, lease, use, distribute in any way or otherwise transfer any rights you acquire under these Terms.


Guarantees

Access to the Site/Service is provided "as is," "as available," however, we do everything possible and take all reasonably possible technical and legal measures to ensure the safe use of our site and ensure the safety and legality of the information you provide.

We do not take responsibility for criminal, illegal, negligent actions, or inactions of third parties related to the use of the Site/Service.

In case of legal proceedings, it will be conducted in accordance with the current legislation of the state of Delaware in the appropriate court with jurisdiction.

If any provision of these Terms of Service is found to be unlawful or invalid, that provision will be limited or excluded to the minimum extent necessary for these Terms of Service to otherwise remain in full force, effect, and enforceability. The failure of either party to exercise any right provided herein shall not be deemed a waiver of any further rights hereunder. Our inability to enforce any part of these Terms of Service does not constitute a waiver of our right to further enforce such or any other part of these Terms. Failure to comply with any provision in any specific instance does not mean that we will waive compliance in the future. For any waiver of compliance with these Terms of Service to be binding, we must provide you with written notice through one of our authorized representatives.


Limitation of Liability

To the maximum extent permitted by applicable law, the administration of TapWeb.link shall not be liable for any incidental, direct, indirect, punitive, actual, consequential, special, or other damages, including loss of revenue, lost profits, moral damages (pain and suffering, emotional distress), cost of substitute goods or services, or similar damages, arising from your use or inability to use the Service (or the termination of such provision for any reason), even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, the administration of TapWeb.link assumes no liability for any content posted or available through the services (including claims of infringement related to such content).


Force Majeure

We are not responsible for the failure to fulfill our obligations under this Agreement if such failure is a result of any cause beyond our reasonable control.


Impossibility of Transfer of Rights and Duties

These Terms of Service are personal to you and may not be transferred by you without our prior written consent. We may transfer, assign, or delegate any of our rights and obligations under this Agreement without any consent.
